The present Terms and Conditions are applicable for goods sold by Aram Eskitzian’s sole proprietorship, trading as “Arma”, through its electronic shop, www.armafabrics.gr (hereinafter “ARMA FABRICS”). Every order placed with our electronic shop entails the acceptance of the present terms and conditions.

E-SHOP Seller Information

Execution of the sale

When you press the “Send Order” button, this means that you are sending to ARMA FABRICS a proposal to purchase the goods in your cart and you agree with the application of these General Purchase Terms.

The confirmation of the reception of such a purchase proposal, which is automatically sent after the submission of your order, only verifies that your order has been received by ARMA FABRICS. However, this does not automatically constitute an acceptance of your proposal for purchase, which can only be accepted after the availability of the products you have ordered has been checked and ascertained, in which case a separate electronic message verifying the acceptance of the order will then be send to you. ARMA FABRICS explicitly reserves the right to accept or decline your proposal, depending on the availability of the products you have selected.

Possible erroneous entry of products or the method of payment/shipment on your behalf shall be borne by you and not ARMA FABRICS.

Product availability

Should the ordered products not be immediately available or not available at the listed price due to the change of the list price at the time of the order and the processing thereof, ARMA FABRICS will inform you as to whether it shall accept your order or not, as well as on the availability and current price or possible delays in the delivery. In case ARMA FABRICS does not accept your order, any payments you may have made shall be cancelled, whereupon a procedure for their refund shall follow, depending on the payment method you have chosen.

ARMA FABRICS checks the accuracy of the listed prices for the products of its e-shop on a daily basis. However and at any event, it explicitly reserves its rights with respect to possible erroneous listing of price due to an error attributable to human or technical factors and which (price) manifestly could not correspond to the usual or average selling price of the relevant product. ARMA FABRICS will inform you with respect to possible errors in the list prices of the products you ordered as well as on their current price. Possible payments made by you in such a case, shall be cancelled.

In any case, you will be informed within a deadline of 5 working days regarding the delivery time for your products.

Delivery – Delivery and return expenses

All domestic deliveries are carried out by the associated courier company. Orders with value less then 50 Euros shall incur a 5 Euro per order charge for shipping expenses. Orders with value of more than 50 Euros are not encumbered with shipping expenses.

Upon the completion of your order, you will be send the tracking number of the shipping, in order for you to be able to directly and immediately track the progress of the transportation of your package, via the courier company’s webpage. Return of products charged on us shall be accepted only via our collaborating courier company.

We process the orders we receive from Monday to Friday on the following working day, from 09:00 in the morning until 14:00 noon. The processing of orders submitted on Saturday, Sunday or public holidays is carried out on the next working day. Delivery times are exclusively up to the courier companies, but may also be affected by the payment method you have chosen (eg the time it takes for a money transfer to be completed depends on the Bank (usually 2-3 working days)).

For shipments to Thessaloniki and provided your order and our acceptance of it have been completed and verified until 12:00 noon, delivery will take place within 5-10 working days, with the exception of extraordinary circumstances affecting the load of courier companies and incurring extraordinary delays.

For shipments outside Thessaloniki and provided your order and our acceptance of it have been carried out and verified until 12:00 noon, delivery take place within 5-10 working days, with the exception of extraordinary circumstances affecting the load of courier companies and incurring extraordinary delays.

In case of hard to reach or remote areas (eg islands or remote provinces), the dispatch and delivery of the products to you may take more time.

In any case, the delivery of your order shall not exceed 30 days, save for force majeure events (transportation strikes, bad weather conditions or periods of increased workload for courier companies, etc.).

Expenses for the shipping and return of products

ABROAD

Customs and import duties are imposed on orders dispatched to countries outside the EU, in compliance with the legislation of each country, which are borne by the customer and are not included in the prices of the products or the shipping expenses.

Return expenses for products sent to you and which are defective or wrong are borne by us, provided they are returned using the courier company we collaborate with and which delivered them to you.

Return expenses for non-defective products shall be borne by you.

Prices cited in this paragraph include VAT.

In any case and for the full informing of the customer, the final shipping cost is calculated at the checkout of the cart.

Checking of products upon receipt

You must check the products you receive upon their receipt since following their receipt you are solely responsible for the risk of chance destruction, deterioration or loss thereof. Your signature on the receipt document denotes that you acknowledge to have received the products of your order correctly and that such do not have any defect.

Non receipt of products

Provided the customer does not receive the product within 30 days after the receipt of the dispatch notice and despite the relevant notification by the courier company, ARMA FABRICS reserves its right to withdraw from the sale. In such a case, the customer shall receive a credit note of value equal to the price of the sale minus the shipping expenses (5 Euros for shipments in Greece and according to the categories in the table above, for shipments outside Greece) which shall be paid by ARMA FABRICS in the same way the customer used to pay the price.

For products originating in a special order and which are tailor made for you, possible non-receipt entails the loss of the price paid and ARMA FABRICS will store them for you for a period of 6 months from the dispatch of the notice for their collection.

In case you state your desire to receive the products afresh, the expenses for their reshipment shall be borne by you, independently of the amount of the order.

Gift cards

In case you proceed with the purchase of a gift card, you will receive by e-mail a unique code corresponding to your gift card. The redemption of the gift card is effected in the following ways:

Α) At our brick and mortar shop (9 Vas. Irakleiou St., Thessaloniki) by anyone showing the e-mail message send to you with the gift card’s code.

Β) At our e-shop, by anyone who, after choosing the products he wants, will use the code of the gift card as the method of payment.

Gift cards do not constitute a product or good and cannot, therefore, be returned, as this would amount to the liquidation of the gift card. The return, however, of products purchased with a gift card is possible, pursuant to all provided for in our return policy.

In case of the return of products purchased with a gift card, the refund of their value will be performed by crediting their value to the available balance of the Card. If the Card has expired when products are returned, the value of the products will be credited in a Credit Coupon which will be delivered to the customer either electronically, provided the purchase was made at our e-shop, or at the brick and mortar shop, if the product was purchased from it.

Gift cards cannot be redeemed in steps, but only as a lump sum transaction, at any time and within a period of six (6) months from their purchase, by selecting products of equal or greater value and paying the difference between the price and the card, if any.

NOTE: Based on Greek legislation and more specifically pursuant to par. 4, article 7 of the Transaction Tax Reporting Code (Law 4093/2012) a retail receipt or invoice is issued at the sale, the delivery or the commencement of the dispatch of the product. No retail receipt will, therefore, be issued for the purchase of the gift card, as no delivery-sale of goods takes place, but rather, the purchase of a right in favour of a third party, which is incorporated in the gift card.

Samples policy

Our shop offers its customers the option to sample fabrics, following arrangements made over the telephone or by e-mail. An entire sample book may be send, which the customer must return. Samples of a 3 * 7 cm. strip of fabric will be send to the customer, charged 1 Euro per piece plus transportation expenses. Entire sample books may be send at a 50 Euro charge (including transportation), as deposit for the return of the sample book. The money spend by the customer on the sample book will be deducted from the order.

Payment and product prices

All prices in armafabrics.gr are in Euro and include the legal VAT. Specifically for textile prices: these are quoted in Euro for running meter, save for the textiles with limited availability which are sold whole as pieces, in which case the quoted price is per piece.

After choosing the products, the customer may select the payment method for the purchase, which may be:

Α) Payment on Delivery (either by cash or debit/credit card),

Β) by debit or credit card,

C) by electronic deposit to bank account, or

D) by PayPal.

Products manufactured following your special order (eg. cutting the fabric to your specifications, sewing of clothes, etc.) cannot be paid on delivery.

Transactions exceeding 500.00€ are not permitted to be performed using cash, consequently cash payment on delivery is not an available option in such a case. However, payment on delivery with a debit or credit card is still possible.

The following credit cards are accepted: Maestro, MasterCard, Visa, Diners and American Express. Payment particulars are encrypted while processed. All online payments via credit card or PayPal are performed in the secure environment of the collaborating Bank or the PayPal online payment platform.

Data entered by the customer during the performance of an electronic payment are not checked nor processed or stored by ARMA FABRICS, but, rather, by the payment provider or/and server, per case applicable. Do note that the safe payment system may require you to verify the transaction via 2 authentication factors, by sending you a written or electronic message with a unique code, subject to the condition that you already have codes for electronic banking, issued by the Bank which has issued your card.

Provided payment by bank deposit with one of the Banks ARMA FABRICS collaborates with, has been selected (cf. information on ARMA FABRICS’ bank accounts here and in the account appendix at the end of these terms), you order shall be completed upon the appearance of the bank transfer at the corresponding bank account held by ARMA FABRICS. The time for the completion and appearance of the wire transfer may vary depending on the Bank (usually 2-3 working days). Should the deposit not be performed within 3 working days, the order is automatically cancelled. Possible charges relating to wire transfers and imposed by the Banks, shall be borne by the customer.

In case where refund is required, said refund will be paid by ARMA FABRICS in the same manner the customer used to pay the price, save if otherwise agreed with the customer, without any culpable or unjustified delay. When your payment was performed by deposit to our bank account or with cash on delivery, in order for us to be able to refund your payment, you must disclose the IBAN of an account where the beneficiary is the person who submitted the order in our e-shop.

Withholding of ownership

Products possibly delivered to you without having being paid in full or in part, shall remain in the ownership of ARMA FABRICS until the final and full settlement of the price.

Right of withdrawal / Return of product

Should the customer be a natural person (consumer) executing the sale for personal use and not to facilitate his professional activity, then said customer reserves the right to withdraw from the sale within a deadline of 14 calendar days, commencing on the delivery of the product to the customer or to the courier indicated by the latter, by returning the product in its original condition and bearing the return expenses and possible decrease of the value of the product.

Returns are not permitted for fabrics bought and cut to your specifications and for gift cards.

Fabrics sold per piece and all men’s accessories can be returned, provided they are in their original state, intact, full, without any wearing down, while they must be returned within a deadline of 14 days from the date the order was received. In case where the product you return is found to have suffered wear and tear or deterioration not the result of the handling of the goods which is necessary in order to ascertain their nature, features and function, the amount to be refunded will be decreased by the amount the product’s value was impaired by (cf. below, term 14).

Exercise of the withdrawal right

You reserve the right to withdraw from the distance sale of non-defective products, exclusively within a deadline of 14 calendar days, by returning the product in its original condition. This right commences upon the day these conditions are received in writing and at any event not before the delivery of the products. The return of products within 14 calendar days or the dispatch of a clear withdrawal declaration which is complemented by the return of the products shall be deemed a timely exercise of the withdrawal right. In any case for the return to be accepted, the product must be complemented by the receipt for the order. The withdrawal declaration shall be send in writing to the following addresses:

Fill the required information directly on the form, sign the form and send it in one of the aforementioned ways.

Provided you exercise your withdrawal right in any of the ways described above, you will receive a confirmation of the receipt of the exercised withdrawal right.

Products are returned on the customer’s expense to the address: Aram Eskitzian, 9 Vas. Irakleiou St., PC 54625, Thessaloniki.

Consequences of withdrawal

In case of the timely exercise of the withdrawal right, any potential decrease of the merchandise’s value must be replaced by monetary compensation, as well as possible benefits ensuing from such a decrease, only in case and to the extend that such decrease is caused by the handling of the product in ways which transgress the common examination of the products and in a manner other than that necessary to ascertain the nature, features and function of the product. Usual examination and handling of the product in order to ascertain the nature, features and function of the product means the assessment of the relative goods as such would have been performed in the manner customary for a brick and mortar shop.

A product which is returned by the customer’s courier service and not the external associate of ARMA FABRICS is returned on the customer’s risk. In any case, the customer shall be borne with the return expenses and possible impairment of the product’s value, the ascertainment of which ARMA FABRICS explicitly reserves until it has received the returned product. Provided the product is received and checked for possible impairment to its value, any monetary obligation to the customer shall be refunded to him (eg delivery expenses, price) in the manner by which the customer paid, save if it is otherwise agreed with the customer. The obligation to refund the money shall be fulfilled without unjustified delay and within a deadline of 14 calendar days from the return of the product.

1.The right of withdrawal pursuant to the provisions of Law 2251/1994 is not applicable:

In cases where the price for the products has been paid at a third party brick and mortar shop, where ARMA FABRICS products are resold and simultaneously, such products were collected from said brick and mortar shop, since the sale is not deemed to have been performed at a distance, but, rather, that it has not been performed by ARMA FABRICS at all.

In cases where the products have been used. The following are examples of the use of a product: its stitching, incorporation with other materials, washing, ironing, cutting, inclusion of components or added materials or parts on the product, etc.

In cases where the delivered products have been manufactured pursuant to the specifications designated by the customer or pursuant to the customer’s personal requirements and customization or which due to their nature are impossible to be returned by shipping. You are not permitted to return gift cards and fabrics you have purchased and which have been cut to your specifications.

In cases where the delivered products are not suitable for return, as soon as they are unpacked, for reasons relating to the protection of health or on sanitary grounds.

In cases of services rendered, after the full service has been rendered, provided the consumer has already acknowledged such in the order, in which case the consumer shall forfeit the right of withdrawal provided the contract has been fully performed.

2.Decrease of product value – refund of value

The consumer may be encumbered with the decrease of the value of a product, provided the way said product has been handled exceeds the acceptable limit of the assessment the customer would have performed in the brick and mortar shop to check the nature, features and functionality of the product. In case of the valid and timely exercise of the withdrawal right and subject to the condition that the product has been returned to ARMA FABRICS, the customer will receive a credit note of value equal to the price of the sale, which shall be redeemed by ARMA FABRICS in the same manner by which the customer has paid the price, save if otherwise agreed with the customer, without culpable or unjustified delay. ARMA FABRICS shall refund any payment received within a deadline of 14 calendar days from the date on which it was informed of the decision to withdraw from the contract.  ARMA FABRICS is justified in denying to refund money until the product is returned to it or until the consumer provides proof that the product was send back, whichever occurs first. ARMA FABRICS reserves the right to deduct return expenses from the refunded amount, which (expenses) are borne by the customer, as well as any possible compensation in case of the destruction, wear and tear or damage to the product, or the impairment of its value attributable to the customer’s actions. At any event, ARMA FABRICS reserves the right to claim in any legal way, any amount by which it was harmed (indicatively: either with respect to the return expenses, or by virtue of the destruction, wear and tear or damage of the product or the impairment of the product’s value, etc.).

Protection of personal data

We inform you that for the purpose of the fulfilment of our obligations stemming from our transaction, we collect your personal data given to us and we keep said data exclusively to fulfil such obligations, as well as for the purposes of abiding by the obligations imposed by the law (eg. issue of lawful vouchers, submission of tax returns, etc.). Such data shall not be transferred to unauthorized third parties, save for our associates, the services of whom are necessary for the performance of the contract (eg. couriers, computer support companies, web hosting companies, etc.). All of our associates have been committed in writing to protect your personal information. Possible customer information on returned products, shall be deleted by ARMA FABRICS and will not be further processed by it.

Consumer rights – Liability – Force Majeure

Consumer rights stemming from the provisions relating to the sale of consumer products and warranties in the Civil Code, as well as the law on Consumer Protection, but also from any other relevant provisions, are in force and effect, as provided for by the aforementioned legal provisions.

Customer claims for compensation or monetary satisfaction of any kind and on any legal basis are precluded. Specifically precluded are claims for damages to the health, life and bodily integrity.

Any claim to compensation or monetary satisfaction of any kind and on legal basis is excluded in case of the occurrence of a force majeure event.

Right to return, repair or replace defective products

Products displayed in our electronic shop may differ in colour from how they actually look (due to various factors such as the characteristics of the photo-shoot, lighting during the photo-shoot, screen resolution, etc.). Such divergences may not be characterized as lack of stipulated quality or as defectiveness of the products ordered.

The consumer is also entitled, within the legal time frame and independently from the right of unjustified withdrawal described above, to exercise any of his rights under the law due to the product’s defectiveness (repair, replacement, discount of price or withdrawal), and in compliance with the conditions posed by the law, additionally by submitting a direct request to ARMA FABRICS.

Provided a product is declared defective by the customer, ARMA    FABRICS explicitly reserves the right to identify the product as such, in order for it to be replaced by a non-defective one or to be repaired, provided this is feasible.

If the defect is minor, the right of withdrawal is not provided by law.

If the defect can be repaired or replaced, the customer must accept the repair or replacement, save if such repair or replacement is uneconomical for the customer.

Provided a product is returned as defective and ARMA FABRICS, following the aforementioned check, ascertains the existence of defects, the customer will be informed with respect to the course of its replacement or repair.

The concession or transfer of rights relating to the defectiveness of products is excluded.

Final provisions

These general terms and conditions are governed by Greek Law.

Jurisdiction for the resolution of any dispute between ARMA FABRICS and the customer lies with the competent Courts of Thessaloniki. For the out-of-court settlement of the dispute, you may also contact the competent bodies for out-of-court settlement of consumer disputes, such as, for example, the General Secretariat for Consumers of the Ministry of Development and Competitiveness (Kanigos Sq., 10181, Athens www.efpolis.gr, tel.:1520, fax:2103843549), the Consumer Ombudsman (www.synigoroskatanaloti.gr, 144 Alexandras Ave., 114 71, Athens, tel.:2106460734, fax:2106460414.), the Committees for the amicable resolution of consumer disputes (article 11, Law 2251/1994) with their registered addresses at Municipalities across the land. Moreover, you can appeal to the European Body for the Alternative Resolution of Disputes, on the relevant Online Dispute Resolution – ODR platform by the European Commission: https://ec.europa.eu/consumers/odr.

The protection offered by laws on contracts concluded at a distance, such as the present terms, is applicable to transactions only with natural persons, who are transacting for reasons not falling under their commercial, small-industrial, business or freelance activity.

In case any of the terms of this agreement is not applicable, the remaining terms shall remain in full force and effect.
